1 - The acquisition of land for construction

The acquisition of new land is first formalized when signing a compromise of sales, then by an authentic act of sale.

Compromise of sale
This document is prepared by the SYMISA, recognized as agent. If no suspension clause exists, the signing of the agreement is followed by the payment of 40% of the sales price, tax-free. In other cases the percentage can be negotiated. After signing the agreement, the company may conduct geological surveys, necessary for the recognition of the ground. The company is also allowed to carry it out on its behalf (with prior clearance from the DDAF and its building permit). The regulation Plan of Development Zone (PDZ) and the specifications are attached.

The authentic act of sale
Initiated by the seller, it occurs within 6 months after signing the agreement. The tax free purchase price of the land, VAT raised, is versed the day of the signature of the act. Depending on the situation, the deed of sale may be done in an administrative form and in franchise fee.

The building permit
The application for a building permit from the municipality can be made upon signing the agreement, in view of the prior corresponding clearing.
Delays of technical regulation are two to four months.

Any implementation application on the site is subject to prior approval, in a file deposited by the company, describing the features of the planned activities. The approval committee shall decide on the following criteria:
the technological nature of the activity
the absence of pollution and nuisance
the quality and number of jobs created
the ratio of the area of the land to the number and quality of jobs
